To my surprise, they have proposed that anyone who proves worhy for the US economy, in the initial 3 year period of the H1B, automatically granted their Green Card. For me this seems to the best proposal ever for reforming the H1Bs.
Surprisingly this makes sense. What they forget however is that you can't give a green card just because that person is here for 3 yrs. There has to be a visa number available.

Here is the situation. I send money every month let us say 1000$ to NRO account. Now in 10 days when the money is withdrawn balance goes to 200$. So really at NO POINT OF TIME the balance reached 10K. but If I add the total amount deposited then it is more than 10K. So is it 10K at any point in time or 10K total ( from Jan to Dec.) Is it just me or???
This information is not on how much you send out. It is how much you ever held in a foreign account. In your case, it was never more than 10K so you dont have to worry. It is a routine info sent to Treasury, and usually no one looks at them unless funds are more than 100K.

when someone asks an unusual question like the one started in this forum? The lady has clearly outlined her reasons for the question in the subsequent posts. But one or more responders have not been good to the person who started the thread. This is not nice.
The right way was to ask the person who posted the original question for the reasons and then start a discussion and provide suggestions/guidance.
My suggestion to the lady would be to communicate/discuss with other Indian couples in the neighborhood/city etc (you live in NJ - so should have no issues there) and get potential options here. I am sure there are many working couples in the region who have kids and face similar issues.

CIR will not happen in Lame Duck as time is very limited. It is so complex atleast 1 to 2 months debate will be needed. Also for US immigration is not critical issue compared to other issues. Last year also H1b Cap reached and gc retrogession was there. I do not think Corporations had big issues in getting people. Big companies could bring people by B1 and L1. Startups and small companies attracted gc holders and current H1 people by giving big Pay checks. Even h1 and gc is increased outsourcing will be done to save cost. EB and H1 relief is more important to potential immigrants not for US congress or Companies. They can wait a few months. I doubt congress will rush to pass any legislation. If something happens it may happen after March. If it wants to happen in Lame Duck the bill should be simple(For example just double the number of gcs or H1bs) But there are lot of provisions like exemptions and market based h1 increase there is no time to debate all. If they try to introduce in hurry and that fails then it may backfire and next time also tough to pass(everyone has to remember that anti immigrants also working on to defeat any immigration related bills).

Everything I came to know about computers-was through IEC Computer Institute rt across the street.That's where I first learnt Pascal and 'C'. Our college didn't have adequate computer lab at all.My lab instructor over there knew more than our HOD Comp Science Dept.

Here is my experience:
Re-entered at Newark NJ POE on Nov 28th 2008. I was on H1B/AP combo.
Spent some time at secondary inspection. There was a big group in front of me and they hogged time. My inspection went very smooth.
However, there was a lady from India with her child. She was given a very hard time. They even telephoned somebody and asked what her roles are...I presume the IO was talking to her employer....The IO looked at the lady and asked " You are saying QA and testing but your employer is saying database maintenance..what exactly you do.."...IO asked for documents but the lady did not have anything concrete....The child was crying meanwhile...She said her husband is in india....I was watching all this sitting in the front row...Then another IO called my name and I went and finished the process and came out of the door.
When I left, I got a feeling that she was asked to go back.
I'd be re-entering US at Newark in June 2009 after my current planned trip. I'm hoping and praying that it would be smooth this time also.

By temporary immigrants, do they mean F-1/H-1B visa holders? I am assuming EAD holders are excluded since they are NOT temporary immigrants or non-immigrants.

I currently am on EAD nd use AP to travel outside the country. I had about 2.5 years remaining on my H1-B when I had my employer withdraw my approved h1-b petition to save on the 2.5 years remaining on h1-b incase i decided to go back to school. My understanding at that time was EAD and AP are all that re required to stay and work in the US legally.
Reading through all the discussions on the new memo it seems like the USCIS can create issues saying I was in unlawful status without an h1-b even though I had AOS pending with EAD and AP valid at all times.
Is it advisable to have my employer re-file for an H1-B on my behalf to be on the safe side or is the damage already done ? Please advise.
Has anyone taken up this dilemma with USCIS ? What do Sheela Murthy and the other lawyers say ?

I am in the process of preparing 2 packets so that if he delays I can file by myself before retrogression hits again.

I may be wrong on the "41" figure. numbersusa mentions that 41 NO votes are required to vote the bill out of the senate and barely 10-15 senators have pledged to vote NO. According to numbersusa, majority of the senators are in favor of the bill (DREAM ACT) and numbersusa is asking all its members to take "immediate action" and contact their lawmakers to vote NO on the bill.

I doing my medical exam next week on the 20th, that's the earliest i could get in MA.
However i'm going to do my x-ray tomorrow, because i always test positive after the TB test, but x-ray negative. Does it hurt to do the x-ray earlier that the actual TB test (PPD)? my doctor said it does not hurt and he will accept it. Does any one know if there going to be a problem with that ?
